Portugal – Persistent structural prison overcrowding & Lack of effective remedy

EPLN & Forum Penal – Associaçação de Advogados Penalistas (Forum Penal – Association of Criminal Lawyers) filed a joint Rule 9 submission to the Committee of Ministers of the Council of Europe in the case Petrescu v. Portugal (no. 23190/17, 2019).

In their submission, EPLN & Forum Penal argue that

  • Structural prison overcrowding persists in Portugal in the absence of any far-reaching penal reform tackling its root causes, in particular the key factor of long prison sentences.
  • There are no effective preventive or compensatory remedies for prisoners to complain of their detention conditions
